Beaumont Tashjian Welcomes its Newest Team Member - Kumar Raja, Esq.

Beaumont Tashjian is pleased to announce that Kumar Raja, Esq. has joined the firm.

Kumar S. Raja, Esq. is a senior associate at Beaumont Tashjian, where he primarily handles the Firm’s litigation and enforcement matters. He also provides general counsel services for the Firm's diverse community association clientele on a wide array of subjects, including risk management and corporate governance. His passion is developing creative solutions which foster community harmony. Board member education and support are cornerstones of Mr. Raja's practice. Mr. Raja has over 10 years of experience representing common interest developments.

Mr. Raja holds a Bachelors of Arts degree in Economics from the University of California, Los Angeles (Dean's Honor List), where he wrote for the school's newspaper (Daily Bruin). At Loyola Law School in Los Angeles (J.D. 2002), Mr. Raja participated in the school's Scott Moot Court Program and completed externships at the LA City Attorney's Office and U.S. Bankruptcy Court (Hon. Kathleen March).

Mr. Raja is a proud member of Community Associations Institute (CAI) and has been an invited guest speaker at state and local CACM and CAI chapters throughout the state. He is an award-winning author having written several articles on Covid-19 topics and new legislation affecting common interest developments.

New Law Update: SB 9 (Atkins) Housing Development: Approvals

Senate Bill 9 (“SB 9”) was approved by the Governor and chaptered as a new law on September 16, 2021. In an effort to address California’s housing crisis, effective January 1, 2022, SB 9 will allow property owners to do the following:

1.   Have no more than two residential units within a single-family residential zone;

2.   Split an urban lot into two parcels.

Moreover, local agencies are required to ministerially approve either action, meaning officials would have to approve the proposed housing development so long as it meets certain standards.

Fortunately, Senator Atkins, author of the bill, specifically stated that the bill does not supersede HOA restrictions. Although SB 9 does not override recorded restrictions, it may have negative effects for community associations.

Contact your association’s legal counsel for review of your governing documents to address lot splitting in your community.

CAI Legal Forum: California Communities

BT Senior Partner, Jeffrey A. Beaumont, Esq., CCAL, and James E. Perero, Esq. with Myers, Widders, Gibson, Jones & Feingold, LLP will be presenting at the CAI Legal Forum, "Covenant & Rule Enforcement with Recalcitrant Harmful Members," on October 14 via Zoom from 9:00 a.m. - 10:15 a.m.

This program will cover how a lovely active adult community suffered years of abuse by a recalcitrant member, who ultimately caused the community severe distress and financial harm. This member was committed to doing what he thought was “just” by: filing frivolous lawsuits against volunteer directors; sending staff threatening, hostile and abusive letters; and sending the association’s insurance carrier claims and threats of litigation. The association found itself faced with insurance carriers not renewing policies, requiring significant deductibles, and increased insurance premiums. Join us for this presentation to hear how the story ends as presenters walk attendees through this community’s saga, revisiting key stages of the dispute and trial, and apply many of their experiences to the difficult issues boards and management face when addressing recalcitrant members.
